Thank you for visiting PeerDeal.com. PeerDeal.com recognizes that privacy is an important matter and operates its services with your privacy protection in mind.

This Privacy Policy describes policies governing PeerDeal.com’s use of personally identifiable information about you when you use PeerDeal.com and its services (collectively, the “Website”), as well as some of the measures PeerDeal.com takes to safeguard use of the Website. You acknowledge and agree that by using the Website, you agree to be bound by the terms and conditions of this Privacy Policy. If you do not so agree, you should not access or use the Website. This Privacy Policy is hereby incorporated into the Terms of Use (the “TOU”) published on the Website. Capitalized terms used in the Privacy Policy and not specifically defined herein will have the meaning ascribed to them in any other policies and guidelines documents posted on the Website (including, without limitation, the TOU and the PeerDeal.com License Agreement).

1. Modifications to Privacy Policy

PeerDeal.com reserves the right to, in its sole discretion, modify the Privacy Policy. Such modifications are effective upon posting. You should, therefore, periodically review the Privacy Policy to ensure you have read the most recent version. You agree to be bound by any modifications to the Privacy Policy. In particular, your continued use of the Website following the posting of any updates or modifications to the Privacy Policy constitutes your acceptance of such changes. If you object to any provision of the Privacy Policy or any subsequent modifications to the Privacy Policy, your exclusive recourse is to immediately terminate use of the Website.

2. Modifications to Personally Identifiable Information

If you need to modify or correct any of your personal information in your account profile (such as an updated address), you may log into your account and make such changes in the manner provided in the screen directions. If your account is terminated for any reason in accordance with the PeerDeal.com TOU, then PeerDeal.com may retain your personal information.

3. Information Collection and Usage

A. You can visit and access certain materials on the Website without providing PeerDeal.com with any personally identifiable information. In other words, you can visit and access certain Website materials anonymously. However, for certain activities on the Website, such as creating an account and registering as a Licensor or Licensee, PeerDeal.com may ask you to provide certain personally identifiable information, such as your name, your email address, a password, your city and state of residence, your telephone number, and other like information. In other words, when you opt to partake in certain activities on the Website, you will no longer remain anonymous.

B. PeerDeal.com may use your personally identifiable information to record and/or store particulars about and support your usage of the Website. For example, and without limitation, PeerDeal.com may use the information provided by you to register and manage your account and deliver certain services to you, to verify your authority to enter the Website and to verify a Licensed Asset as yours, to process transactions on the Website, to log information about your usage of the Website, to provide notices to you regarding certain services, to process any communications from you to PeerDeal.com, and to improve the functionality and administration of the Website, its features, and content.

C. PeerDeal.com will not use your personal information to send advertising or like marketing messages to you, without your consent. However, PeerDeal.com may use your personal information without your further consent for messages related to customer service purposes (e.g., general service announcements), Website updates, or other such non-advertising or administrative undertakings. In addition, PeerDeal.com will not provide, rent, trade, or sell your personally identifiable information to any third party company or like entity, except as described in the “Information Disclosure” section below, part “D.”

D. PeerDeal.com may use cookies and other like tools to, among other things, enhance your Website usage, in that you will not have to re-enter certain information during repeated visits to the Website (e.g., a cookie may record your password). In addition, cookies assist PeerDeal.com in tracking user preferences and patterns and tailoring your experience on the Website to your individual preferences. A “cookie” is a small data file containing a string of characters that is downloaded onto your computer upon your fist visit to the Website that uniquely identifies your browser. While most browsers are set up to automatically accept cookies, you can reset your browser to refuse cookies. If you reset your browser to refuse cookies, however, certain services and aspects of the Website might not properly operate. E. PeerDeal.com may collect and store aggregate data about its user base. For example, and without limitation, PeerDeal.com may log the total number of visitors to the Website or any part or page thereof, dates and times of accessing of the Website, Internet protocol (aka “IP”) addresses of computers, operating system specifics, and browser software types. PeerDeal.com may evaluate this data for demographic and statistical purposes (e.g., for determining the number and type of visitors to different areas of the Website), for administrative purposes (e.g., for ensuring that the Website is functioning properly and for improving the utility of the Website), and for purposes of tracking trends and users’ actions. Such aggregate data will be amassed, utilized and divulged in the aggregate only. Your personal information will not be identified in such aggregate data.

4. Security Measures

A. PeerDeal.com utilizes certain security measures to aid in the protection of your personally identifiable information from disclosure, loss, unauthorized access, modification, and the like. Such security measures may involve, without limitation, encryption, password protection, and assorted electronic and managerial methods. Note, however, that while PeerDeal.com utilizes all reasonable security efforts and measures, no means of Internet transmission or electronic storage may be perfectly secure. Therefore, PeerDeal.com makes no pledge of such perfect security with respect to your information. In addition, note that unless PeerDeal.com explicitly advises you otherwise, the email functionality on the Website does not provide a method for totally secure, confidential communications; therefore, like most Internet email correspondence, your email may potentially be accessed and read by others during transmission. PeerDeal.com recommends that you not use email to transmit confidential or sensitive information (e.g., Social Security numbers).

B. If you do not want to provide personally identifiable information through the Website, then you may choose to not create an account with the Website. While you may still be able to browse certain materials on the Website, you will not have access to other services and materials.

5. Children’s Policy

PeerDeal.com is not intended for the use of children under the age of 13 and does not aim to attract children under 13 to the Website. PeerDeal.com does not knowingly collect personal information from children under 13. In fact, PeerDeal.com requires users to acknowledge and agree that they are 18 years old or older.

6. Information Disclosure

A. PeerDeal.com may disclose your personally identifiable information if required to do so by law, in order to cooperate with a subpoena, court order, regulation, or governmental investigation, or in other legally limited situations (e.g., to protect your account from fraud, to investigate violations of PeerDeal.com’s TOU, to defend against legal claims, or to aid in any similarly protective, investigative, or defensive activity).

B. PeerDeal.com may share your personally identifiable information with third party entities (e.g., vendors) that provide services to PeerDeal.com. PeerDeal.com will endeavor to ensure that such entities use such information only to the extent necessary to perform such services. At times, PeerDeal.com may direct you to a third party service or vendor in order to process payment for certain activities on the Website. Note that any personally identifiable information that you provide to such service or vendor will be governed by the privacy policy associated with that third party’s website. While the Website may direct you to particular third party services (for processing payments or otherwise), possibly via links to other websites, and while PeerDeal.com strives to link only to websites that highly value and maintain privacy, PeerDeal.com is not responsible for the privacy policies enacted by other such websites, including, without limitation, the security measures employed by them.

C. PeerDeal.com may share your personally identifiable information with others to resolve technical matters where the information pertains to page views generated by a bot or other such potentially disruptive, invasive mechanisms.

D. In the event of a merger, acquisition, sale or other like corporate restructuring that PeerDeal.com may engage in, PeerDeal.com may assign or transfer your personally identifiable information to a successor, including without limitation, to a buyer of all or substantially all of PeerDeal.com’s assets.

E. After you create a Website account, other users of the Website may have access to some information about your account activity. For example, other users may be able to view the date that you opened your account, the last date you logged into your account, your account user name, and your Licensed Assets.

F. If you voluntarily divulge any personal information online (e.g., on any profile or comment pages, a favorite Licensed Asset page, a ratings page for Licensed Assets, or other publicly accessible section), such information may be viewed, collected, and utilized by others. Furthermore, any information you submit to PeerDeal.com via email becomes PeerDeal.com’s property, which PeerDeal.com may use or discard in its sole discretion. For example, PeerDeal.com may utilize such information to enhance the Website’s performance, or PeerDeal.com may look at it and dispose of it.
